Mortgage discharge in Portugal, what it is and why it matters when selling your home

If you are preparing to sell a property in Portugal that once had a mortgage attached to it, you are likely to come across a term that raises a lot of questions, the mortgage discharge, known locally as the “distrate bancário”. In this article, I explain, in simple terms, what this document is, what it is for, and when you should deal with it.

What a mortgage discharge is

A mortgage discharge is the document issued by the bank once a mortgage on a property has been fully paid off. In other words, once the owner has repaid the entire loan taken out to buy the home, the bank no longer holds any claim over the property and issues this document to confirm that fact.

In practical terms, the mortgage discharge is the bank’s formal authorisation for the mortgage to be cancelled at the Land Registry, the Conservatória do Registo Predial. Without this authorisation, the mortgage remains registered against the property, even if the loan has already been paid in full.

Without the discharge, the mortgage stays registered even after the loan has been paid off.

Why the mortgage discharge is so important

Many owners assume that, as soon as they pay off their home loan, the property is automatically free of any charge. In reality, this does not happen on its own. Until the discharge has been requested from the bank and the cancellation of the mortgage has been registered, the property will continue to appear at the Land Registry as mortgaged.

This can create serious complications when it comes to selling the property, including:

  • Delays to the completion deed, since the notary requires an up to date Land Registry certificate showing no outstanding charges.
  • Uncertainty for the buyer, who naturally wants assurance that they are purchasing a property free of encumbrances.
  • Lost time and stalled negotiations, in cases where the discharge has not yet been requested and must be rushed through with an interested buyer already waiting.

For these reasons, the mortgage discharge is an essential step, not a minor formality, whenever you plan to sell your home.

How and when to request the mortgage discharge

The discharge should be requested directly from the bank where the mortgage was taken out, ideally as soon as the loan is paid off in full, whether because the mortgage term has ended or because you have made a full early repayment.

The process usually involves the following steps:

  • Confirming with the bank that the mortgage has been paid off in full.
  • Formally requesting the mortgage discharge, usually through your account manager or the bank’s legal department.
  • Waiting for the bank to issue the document, which can take a few weeks depending on the institution.
  • Submitting the discharge to the Land Registry, so the cancellation of the mortgage can be formally recorded.

It is important not to leave this process until the last minute. If you already know you are going to sell the property, the right time to request the discharge is as soon as the loan is settled, not only once an interested buyer appears.
